GOVERNMENT REGULATION
of 10 July 2017
on the minimum technical requirements for the shooting range for ammunition, the blast hole for the destruction of ammunition and special equipment for the firing, firing or destruction of ammunition, and the mandatory requirements of their operating rules
The Government hereby orders pursuant to § 79 (1) (e) of Act No. 119 / 2002 Coll., on Firearms and Ammo (Act on Weapons), as amended by Act No. 229 / 2016 Coll.:
§ 1
Subject matter
(1) This Regulation provides for:
(a) the minimum technical requirements for the shooting range for ammunition, the blast hole for ammunition destruction and special equipment for firing, firing or destroying ammunition; and
(b) the mandatory requirements of the operating order of the shooting range for ammunition, blasting pits for ammunition destruction or special equipment for firing, firing or destroying ammunition.
(2) The obligation to ensure compliance with the requirements laid down in this Regulation shall be the responsibility of the shooting range operator for munitions, blasting pits for ammunition destruction or special equipment for firing, firing or destroying ammunition.
§ 2
Definition of terms
For the purposes of this Regulation:
(a) tunnel shooting range for ammunition shooting range for ammunition located in a tunnel with a safe capture of missiles and shrapnel or parts of missiles along the flight path;
(b) long range shooting range for ammunition shooting range for open field shooting;
(c) the firearm sector for the ammunition corridor defined by the remote firing site and the impactor, depending on the type of shooting;
(d) by the length of the firing range firing range for ammunition, the sum of the highest range of the most powerful weapon for which the shooting range is intended, increased by 10% and the culling effect of the most powerful ammunition for which the shooting range is intended, or such distance of shooting for which the ammunition range is designed and for which the construction of the impactor and the security of the endangered area provided for in Section 5 ensures that the fire escape cannot occur outside the firing sector;
(e) the vulnerable area of the area surrounding the fire sector or the place of launch or destruction of munitions in which persons or property may be threatened at the time of the shooting, firing or destruction of ammunition, in particular by direct effect of the shooting, pressure, sound or seismic wave or splinters and stones.
§ 3
Sound and light signalling and permanent warning tables
(1) If the security of the endangered area of the shooting range for ammunition, the blast pits for the destruction of ammunition or special equipment for the firing, firing or destruction of ammunition by means of the security features referred to in Section 5 (3) (b) does not completely prevent unauthorised persons from entering that vulnerable area,
(a) they shall be placed at the border of an endangered area unsecured by security features in accordance with Section 5 (3) (b) of the warning tables to be indicated and displayed:
1. text "Life dangerous! No entry into the reserved area and contact of the found material! ',
2. the security marks "unauthorised entry" and "do not touch" under other legislation governing the appearance and location of security signs and the introduction of signals (1); and
3. where appropriate, additional warnings appropriate to local conditions; and
(b) a device shall be installed to enable sound and, where appropriate, appropriate lighting to be performed at the beginning and end of the shooting, detonation or destruction of the ammunition, in such a way that sound signals are clearly audible at least at the limits of the vulnerable area and light signals are clearly visible at least on the access routes to the endangered area.
(2) The warning plate shall be at least 40 x 25 cm and placed at a height of 2 m above the ground level so that it is clearly visible from all directions of possible access to the vulnerable area. The distance between the warning tables shall not exceed 20 m. The warning table has a yellow background with text and pictograms of red or black.
3. (b) they must be listed in the operating order of the shooting range for ammunition, blasting pits for the destruction of ammunition or special equipment for firing, firing or destroying ammunition, so that the sound signals are not interchangeable. The meaning of the signals shall also be described on the warning table.
§ 4
Provision of coupling technology
The ammunition firing range, the ammunition shredder pit and the special equipment for firing, firing or destroying ammunition shall be equipped with a telephone, radio station or other means of communication enabling communication with the person performing the work in the vulnerable area.
§ 5
Endangered area security
(1) The specific means of securing the vulnerable area is determined taking into account local conditions and the type and type of ammunition shot, fired or destroyed. In determining the specific means of security, account shall be taken, in particular, of the fact that the entire vulnerable area is protected against the entry of unauthorised persons under paragraph 3 (a). (b) or located in a closed area.
(2) The hazardous area of the shooting range for munitions, blasting pits for the destruction of ammunition or special equipment for the firing, firing or destruction of munitions must be secured by the security features so as not to endanger the life or health of persons as a result of the firing, firing or destruction of ammunition, including the threat as a result of the possible occurrence of unexploded ammunition in the endangered area.
(3) Endangered space security shall be performed by combination
(a) safety features to limit the effects of the adverse effects of firing, firing or destruction of ammunition, which may include in particular:
First tunnels,
2. ditches,
3rd wall,
4.
5. palisades; or
6. capture devices and missile traps,
(b) security features to prevent unauthorised persons entering an endangered area unless the endangered area is fully secured in accordance with (a), which may include in particular:
1. fencing; or
2. bolts,
(c) security features for the detection of unauthorised persons entering an endangered area unless the endangered area is fully secured in accordance with (a) or (b), which may include in particular:
1. physical surveillance; or
2. technical means for indicating and monitoring the entry and movement of persons; and
(d) where appropriate, other technical and organisational security measures which may include in particular:
1. direction limitation devices,
2. device limiters,
3. guidance only aimed shooting on command when checking the correct aim; or
4. Shots fired only from weapons firmly fastened in the shooting stool with a fixed direction of shooting and with a purpose.
(4) The space around the fences, walls and bays or other similar safety features shall be kept readily accessible for inspection and maintenance.
(5) The safety features referred to in paragraph 3 (b) and (c) which are not permanently installed shall be put into function before the start of the shooting, firing or destruction of the ammunition and shall remain operational until the completion of the shooting, firing or destruction of the ammunition.
§ 6
Access paths
The access routes to the ammunition range, to the ammunition pick-up pit or to the special equipment for firing, firing or destroying ammunition and the roads used for operating them shall be maintained in a state which allows them to operate properly and safely.
Additional minimum technical requirements for ammunition range
§ 7
(1) The ammunition range is located outside the premises of other establishments of the same ammunition range operator or at the edge of the ammunition range. In the case of a semi-covered firing range for ammunition above 30 mm, the firing range sector for ammunition shall be distant from all structures and areas likely to be compromised by the handling of ammunition or used explosives, except for the service guards and objects necessary to operate the shooting range, to the sides and to the rear of at least 200 m; This does not apply if the threat is completely excluded by the installed safety features or properties of the ammunition used, in particular when it comes to the firing of inert ammunition without the formation of shrapnel.
(2) The firing positions and the endangered space behind them are separated from the other ammunition range objects and equipment. For a semi-covered firing range for ammunition above 30 mm, this section shall be carried out with a protective wall or a bead.
(3) The direction of the shooting shall normally be oriented into an area with terrain obstacles, such as hills, terrain waves or potholes.
(4) Laboratory workshops for ammunition are separated from firing stations.
(5) In the case of a munitions tunnel shooting range, the individual firing sectors shall be separated by a protective wall or wall whose height is determined by the purpose for which they were built.
(6) In the case of long range firearms for ammunition above 30 mm, the distance between the non-protected adjacent firing sectors shall be at least 500 m. This distance may be reduced if the firing positions are protected against the pressure effect of the shot, if the characteristics of the ammunition used allow it.
(7) When firing ammunition with a radiant, incendiary or penetrating firearm, measures shall be taken to limit fire formation by selecting the material of the impactor and creating the possibility of effective firefighting.
§ 8
(1) The width of the range for ammunition is determined by the type of shooting. If the shooting range for ammunition is intended to be fired under a non-zero gear in the field, the width shall be determined from the sum of possible lateral deviations and the shrapnel effect of the missile. The distance found shall be increased to each side by 500 m throughout the length of the shooting range as a lateral security. The width of the lateral collateral may be reduced accordingly if appropriate safety features are installed to limit the adverse effects of the shooting, firing or destruction of ammunition, depending on the installed safety features, to the limits of the vulnerable area.
(2) If there is a shooting range for ammunition intended for shooting with an angle of impact up to 25 °, it is necessary that the possible reflection of the missiles is eliminated by selecting the terrain of the impactor or by appropriate safety features to reduce the adverse effects of the shooting, firing or destruction of the ammunition. If the reflection of the projectiles cannot be completely excluded, the width of the range range for ammunition shall be determined as the sum of a quarter of the highest range of the most powerful weapon for which the range is intended and the shrapnel effect of the ammunition. The distance determined shall be increased to each side by 500 m along the entire length as a lateral protection. Similarly, the area at risk in the axis of the fire sector behind the impactor shall be determined. The width of lateral locking and the vulnerable area beyond the impact site may be reduced accordingly if appropriate safety features are installed to limit the adverse effects of the shooting, firing or destruction of ammunition, depending on the safety features installed, to the limits of the vulnerable area.
(3) When determining the length and width of the range for ammunition intended for anti-aircraft shooting, account shall be taken of the distance of the shrapnel, which may be up to half the height of the blast, depending on the wind force.
(4) An impactor which is not equipped with effective safety features to reduce the adverse effects of the shooting, firing or destruction of ammunition shall be placed in a separate space away from all structures and areas which could be threatened by the shooting, firing or destruction of ammunition, except for the service guards and objects necessary for operating the shooting range, to the sides and to the rear of at least 700 m. This distance may be reduced accordingly in the case of ammunition firing sites with a protected impact site or if the characteristics of the ammunition used permit so permit.
(5) The ammunition tunnel shooting range capture devices shall be adjusted so as to avoid penetration or reflection of the bullets during the shooting. When firing on armor, the firing sector shall be covered or measures shall be taken to prevent shrapnel injury during the period of the shooting in the vulnerable area.
Additional minimum technical requirements for the blast pit for the destruction of ammunition
§ 9
(1) The shredding chamber for the destruction of ammunition cannot be established in the vicinity of structures and areas likely to be threatened by the handling of ammunition or the possible use of explosives, in particular near residential buildings, production facilities, transport infrastructure or engineering networks. The requirements of the first sentence shall be deemed to be met if the safety distances are met under another legislation which defines the safety distances for construction and areas intended for the manufacture, processing or storage of explosives (2).
(2) A shredding hole for the destruction of ammunition is usually located in enclosed terrain, such as pothole, valley, field wave or forest.
(3) The site for the installation of a shredder pit for the destruction of ammunition shall not have a stony base which could lead to the evisceration of stones outside the demarcated vulnerable area, and the area within a radius of at least 25 m from the destruction site shall be removed from the forest area, grass and other flammable materials. The shredder chamber for the destruction of ammunition shall be equipped with an operating shelter, a special location for the storage of ammunition intended for destruction and a signalling device, and may also be equipped with a manual ammunition storage or an explosive storage). The operator's compartment shall be resistant to the effects of destroyed ammunition.
(4) The distance between shelters and other structures from the destruction site shall be determined according to the method of destruction and the maximum quantity of ammunition destroyed and taking into account its type and type. If the ammunition disposal area is secured by a bead, the shelter can be located on the outside of the wall.
§ 10
(1) Only munitions of the same kind can be destroyed together in the shredding pit for the destruction of ammunition. If it does not jeopardise the safety of the operation of the shredding pit for the destruction of ammunition, ammunition of different species may be destroyed together under the conditions laid down in its operating order. In the event of the destruction of the ammunition, the total maximum mass of explosives which have been taken into account in the destroyed ammunition and the explosives used for the destruction of the ammunition authorised for a specific tear hole shall not be exceeded.
(2) When destroying ammunition in a shredding pit, it is necessary to select a method of destruction that will lead to a reliable destruction of ammunition; If the nature of the ammunition does not allow it, it cannot be destroyed in the shredding pit for the destruction of the ammunition by burning the ammunition.
§ 11
Additional minimum technical requirements for special equipment for firing, firing or destruction of ammunition
(1) Special equipment for the firing, firing or destruction of ammunition cannot be established in the vicinity of other structures and areas likely to be threatened by the handling of ammunition or the possible use of explosives, in particular near residential buildings, public roads and civil engineering networks. The requirements of the first sentence shall be deemed to be met if the safety distances are met under another legislation which defines the safety distances for construction and areas intended for the manufacture, processing or storage of explosives (2).
(2) Where special equipment for the firing, firing or destruction of ammunition is intended for the firing, firing or destruction of ammunition in the open air, the provisions of this Regulation shall apply mutatis mutandis to them and its operating rules to the ammunition firing range or to the blast pit for the destruction of ammunition.
§ 12
Rules of operation of the shooting range for ammunition, blasting pits for ammunition destruction or special equipment for firing, firing or destroying ammunition
(1) The mandatory contents of the operating order of the shooting range for ammunition, blasting pits for the destruction of ammunition or special equipment for the firing, firing or destruction of ammunition are:
(a) personal data or data identifying the legal person of the holder of the general munitions licence, who is the operator of the shooting range for munitions, blasting pits for ammunition destruction or special equipment for firing, firing or destroying ammunition;
(b) an indication of the location where the shooting range for ammunition, the shredder pit for the destruction of ammunition or special equipment for the firing, firing or destruction of ammunition are operated, including an indication of the owner of the land on which they are operated, unless it is identical to the person referred to in (a);
(c) the definition of the time of day and of year allowed at the shooting range for ammunition, in the shredding pit for the destruction of ammunition or in a special equipment for firing, firing or destroying ammunition to conduct firing, firing or destroying ammunition;
(d) the name, names, surname and telephone contact of any holder of a higher munitions licence or a pyrotechnic survey licence in charge of shooting, firing or destroying ammunition at the ammunition range, in the ammunition shredder pit or in a special equipment for firing, firing or destroying ammunition and supervising its operation;
(e) a clear situation drawing of the shooting range for ammunition, blasting pits for the destruction of ammunition or special equipment for the firing, firing or destruction of munitions, indicating the lawful direction of the shooting, the firing point or the destruction of ammunition, including the definition of fire sectors, shelters and other objects located in their space and the definition of an endangered area;
(f) an indication of the type and type of ammunition authorised to be fired and the type and type of ammunition authorised to launch or destroy, including the maximum permitted amount of single-firing ammunition fired or destroyed, expressed in terms of the number of pieces for each type and the calibre of the ammunition or the mass of the packed explosive for that type of ammunition and explosives used to destroy the ammunition;
(g) minimum and maximum range of shooting range for ammunition,
(h) method and procedure for the destruction of ammunition in the shredding pit for the destruction of ammunition;
(i) the procedure for the firing, firing or destruction of ammunition in a special equipment for firing, firing or destroying ammunition;
(j) the rules on the safety of the shooting range for ammunition, blasting pits for the destruction of ammunition or special equipment for the launch, shooting or destruction of ammunition, in particular the principles of the handling of ammunition and weapons in their premises and the principles for access and registration of persons in that area;
(k) the principles of the exercise of oversight over the operation of a shooting range for ammunition, a blast pit for the destruction of ammunition or a special equipment for the firing, firing or destruction of ammunition;
(l) the scope and content of the instruction necessary to maintain the safety in the endangered area of the shooting range for ammunition, blast pits for the destruction of ammunition or special equipment for the firing, shooting or destruction of ammunition, which must always be provided to persons present in that area, including persons providing physical patrols, and the method of recording the execution of such instruction,
(m) the definition of personal protective equipment which are persons located in the firing range area for ammunition, blasting pits for the destruction of ammunition or special equipment for the firing, firing or destruction of munitions must be used between the warning signals indicating the start and end of the shooting, firing or destruction of ammunition;
(n) the method of audible and light-signalling before and after the shooting, firing or destruction of ammunition, and the form and location of warning tables;
(o) principles for ensuring communication with the person performing the work in the vulnerable area;
(p) the method of securing the endangered area of the shooting range for ammunition, the blasting pits for ammunition destruction and the special equipment for firing, firing or destroying ammunition;
(q) the procedure for the failure of ammunition and the procedure for the detection, destruction or disposal of unexploded ammunition in the ammunition firing range area, the shredding pits for the destruction of ammunition or special ammunition firing, firing or destruction equipment, distinguishing the case of on-site surveillance after the shooting, firing or destruction of ammunition from the situation where it is necessary to carry out a pyrotechnic survey of the site, in particular in the event of termination of the ammunition firing range, the blasting pits for the destruction of ammunition or the special launch, firing or destruction of ammunition;
(r) the manner in which records are kept in the operating logbook of activities carried out in the ammunition range, in the ammunition shredder pit or in a specific ammunition firing, firing or destruction facility;
(s) the emergency procedure; and
(t) other communications relevant to the technical solution of the shooting range for munitions, blasting pits for ammunition destruction or special equipment for firing, firing or destroying ammunition and the safety of their operation.
(2) The operating rules of the munitions shooting range, the blasting pits for the destruction of ammunition or special equipment for the firing, firing or destruction of ammunition shall include an explicit warning that if explosives are used in the destruction of ammunition, the requirements of another legislation governing the handling of explosives must be complied with (3).
(3) The requirements of the operational order of the shooting range for munitions, blasting pits for the destruction of ammunition or special equipment for the firing, firing or destruction of ammunition referred to in paragraph 1 (e), (f), (g) and (p) shall be verified by an expert in the field of ballistics or in the field of ammunition and explosives.
§ 13
Final provision
This Regulation has been notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
§ 14
Efficacy
This Regulation shall enter into force on 1 August 2017.
