GOVERNMENT REGULATION
of 22 June 2016
amending Government Regulation No. 163 / 2002 Coll., laying down technical requirements for selected construction products, as amended by Government Regulation No. 312 / 2005 Coll.
The Government orders pursuant to § 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 205 / 2002 Coll. and Act No. 34 / 2011 Coll., ("the Act ') to implement § 11a (2), § 12 and 13 of the Act:
Government Decree No. 163 / 2002 Coll., laying down technical requirements for selected construction products, as amended by Government Decree No. 312 / 2005 Coll., is amended as follows:
1. In footnote 1, the words "Government Decree No. 127 / 2004 Coll. 'are replaced by the words" subsequent regulations'.
2. in Article 1 (1) (a), the words "designated by the manufacturer or importer" shall be replaced by the words "or a set designated by" and the word "his" shall be replaced by "theirs."
3. In Paragraph 1, the dot is replaced by a comma at the end of paragraph 1 and the following point (h) is added:
"(h) a product assembly placed on the market by one manufacturer consisting of at least two separate components to be assembled for incorporation into the construction."
4. Paragraph 1 (3), including footnote 1a, reads:
"(3) This Regulation shall not apply to products whose assessment and verification of constancy of performance is laid down in the directly applicable European Union regulation on construction products (1a).
(1a) Regulation (EU) No 305 / 2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89 / 106 / EEC, as amended. ';
5. footnote 2 shall read:
"(2) For example, Article 156 of Act No. 183 / 2006 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended, Decree No. 268 / 2009 Coll., on Technical Requirements for Construction, as amended by Decree No. 20 / 2012 Coll., Decree No. 398 / 2009 Coll., on the General Technical Requirements for the Handicap Use of Buildings, Act No. 100 / 2001 Coll., on the Protection of Environmental Effects and on the Amendment of Certain Related Acts (Act No. 272 / 2011 Coll., Act on the Assessment of Environmental Effects, Act No. 185 / 2001 Coll., Act No. 350 / 2011 Coll., on Chemical Substances and Amendments to Certain Laws, as amended by Act No. 258 / 2000 Coll., Act No. 18 / 1997 Coll., Act on the Mild.
6. In Article 5 (2) (c), the words "initial verification at the place of production 'shall be inserted after the words" to be carried out'.
7. In Article 5 (4), the words "at the place of production 'are deleted after the words" at the manufacturer's place of production'.
8. § 5a, including the title reads:
Certification without supervision tests
(1) Paragraph 5 (1) to (3) shall apply mutatis mutandis to certification without supervision tests.
(2) The authorised person shall supervise the proper functioning of the production control system of the manufacturer at least once every 12 months. The authorised person shall issue a report on the assessment of supervision and shall transmit it to the manufacturer. If the authorised person finds that the production control system required is functioning or that the product characteristics required are not functioning, he shall be entitled to revoke or amend the certificate issued to him.
(3) The authorised person shall, at least once every 12 months, supervise the proper functioning of the control of products with the importer. The authorised person shall issue a report on the assessment of supervision and shall transmit it to the importer. Where an authorised person identifies deficiencies, he shall be entitled to revoke or amend the certificate issued to him. ';
9. in Article 6 (2) (a), the words "initial verification at the place of manufacture and," the words "Article 6 (1) (d)" shall be replaced by "paragraph 1 (d)" and the words "Article 6 (1) (a)" shall be replaced by "paragraph 1 (a)."
10. in Article 6 (2) (c), the words "at the place of production" shall be deleted;
11. in Article 6 (3), the words "carrying out initial verification at the place of manufacture or" shall be inserted after the words "the option";
12. in Article 10, the text "§ 6" is replaced by "§ 5a."
13. In Paragraph 13 (1) of the Introductory Part of the provision, the words "provided to users of construction products in paper form or on a website 'shall be inserted after the words" in the Czech language and'. The declaration of conformity shall be marked with a unique, unmistakable identifier within the meaning of point (b), which allows the product to be clearly identified. Declaration of conformity further '.
14. footnote 3 is deleted, including the footnote reference.
15. footnote 4:
"4) Act No. 183 / 2006 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended."
16. In Section 13a, the words "in which case the importer's tasks under Sections 2 to 8 and Section 10 may also be performed by a distributor or an authorised representative 'shall be added at the end of the text of paragraph 2.
17. in Article 13a, the following paragraph 3 is added:
"(3) Where a distributor or an authorised representative is referred to in paragraph 2, they shall be subject to the obligations of the importer. ';
18. Annex No 1 reads as follows:
"Annex No 1 to Government Decree No. 163 / 2002 Coll.
ESSENTIAL REQUIREMENTS
The products must be suitable for constructions so that they are (as a whole and individual parts), while respecting the economy appropriate for the intended use of the buildings, while meeting the essential requirements for constructions laid down in the directly applicable European Union1 Regulation, governing the conditions for the marketing of construction products.
These essential requirements shall be met during normal maintenance for an economically reasonable service life, provided that the effects of the normally foreseeable effects on the buildings are applied. The product shall maintain the technical characteristics during its economically reasonable service life, as long as the performance indicators of the construction are maintained at a level compatible with the performance of the above construction requirements.

19. In Annex 2 to the group "1. Construction products for concrete and reinforced concrete parts of buildings" item 2 reads:

20. In Annex 2, Group "1. Construction products for concrete and iron-concrete parts of buildings" under heading 3, the words "poroconcrete and mortar 'shall be inserted after the words" concrete'.
21. In Annex 2, Group "1. Construction products for concrete and reinforced concrete parts of buildings' under heading 4, the words" and secondary components' shall be inserted after the word "Additives'.
22. In Annex No 2 to group "1. Construction products for concrete and reinforced concrete parts of buildings', entry 12 (a), the words" and ceilings' are inserted after the words "walls'.
23. In Annex No 2 to the group "2. Construction products for masonry" item 2:

Transitional provisions
1. Administrative proceedings initiated before and until the date of entry into force of this Regulation shall be completed and the rights and obligations relating thereto shall be assessed in accordance with Government Regulation No. 163 / 2002 Coll., as effective before the date of entry into force of this Regulation.
2. Documents issued or issued in conformity assessment before the date of entry into force of this Regulation may be used as evidence of conformity assessment or as evidence for the drawing up of documents of conformity assessment pursuant to Government Regulation No 163 / 2002 Coll., as effective from the date of entry into force of this Regulation.
Final provision
This Regulation has been notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Regulation shall be binding in its entirety and directly applicable in all Member States. This Decision shall enter into force on the date of its adoption.
