amending Decree No 202 / 2003 Coll., on animal health requirements for fresh meat, minced meat, meat preparations and meat products, as amended by Decree No 375 / 2003 Coll., and Decree No 381 / 2003 Coll., on animal health requirements for aquaculture animals and aquaculture products, fishery products and live bivalve molluscs and on animal health conditions for their importation from third countries
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., ("the Act ') for the implementation of Section 22 (2) (b) of the Act:

Amendment of the Ordinance on animal health requirements for aquaculture animals and products thereof, fishery products and live bivalve molluscs and on animal health conditions governing their importation from third countries
Čl. II
Decree No 381 / 2003 Coll., on animal health requirements for aquaculture animals and products thereof, fishery products and live bivalve molluscs and on animal health conditions governing their importation from third countries, shall be amended as follows:
1. in § 2 (p), the word "fresh" is replaced by "chilled."
2. in Paragraph 2 (w), "40" is replaced by "44."
3. In Article 24, the following paragraph 3 is added:
"(3) Clams and marine gastropods collected in the areas referred to in points 1 (b) and (c) of Part A of Annex 8 to this Regulation which have not been relayed or cleaned before marketing must be subjected to treatment to suppress the growth of pathogenic micro-organisms in accordance with Annex 9 to this Regulation."
4. In Annex 4, note (6), the word "indicate 'is replaced by" indicate their total number'.
5. In Annex 6, Part C, Section I. (2) (a), "(d) and (f) 'is replaced by" (d), (e) and (f)';
6. In Annex 6, Part In point 17, the words "point 1 'are replaced by the words" first sentence'.
7. In Annex 6, Part I, points 18, 19, 20, 21, 22 and 23, "point 2 'is replaced by" point 1'.
8. In Annex 6, Part In point 24, "3 'is replaced by" 2';
9. In Annex 6, Part In point 25, "5 'is replaced by" 4';
10. In Annex 6, Part In point 26, "6 'is replaced by" 5';
11. In Annex 6, Part I, "10 'is replaced by" 9'.
12. In Annex 7, Part In the second line of point 8, the word "fish 'is replaced by" products'.
13. The first sentence of point 10 of Part B of Annex 7 shall read: "Shipowners or their representatives shall take all measures necessary to ensure that fishery products are not handled or handled by persons who may contaminate fishery products until it is demonstrated that they can carry out such activities safely. '
14. In Annex No 8, the following Part A is inserted:
"A
CONDITIONS FOR PRODUCTION AREAS
1. The location and boundaries of production areas shall be determined by the competent authority in such a way as to identify the area from which the bivalve molluscs live:
(a) may be collected for direct human consumption. Live bivalve molluscs collected from these areas shall comply with the requirements set out in Part E of this Annex,
(b) may be collected but may be placed on the market for human consumption after treatment at the purification centre or after relaying. Live bivalve molluscs from these areas may not exceed 6 000 fecal coliform bacteria per 100 g of muscle or 4 600 E. coli per 100 g of muscle in 90% of the samples in five tubes and three dilutions.
After cleaning or relaying, all the requirements set out in Part E of this Annex shall be met,
(c) they may be collected but may be placed on the market for human consumption only after long-term relaying (lasting at least 2 months), which may be associated with cleaning or may be followed by intensive cleaning lasting for a period fixed by a decision of the Union institutions to meet the requirements referred to in (a).
Live bivalve molluscs from these areas shall not exceed 60 000 fecal coliforms per 100 g muscle in five tubes and three dilutions for the MPN test.
2. Any change in the definition of production areas as well as their temporary or permanent closure shall be notified immediately by the competent authority to the persons concerned, in particular to producers and operators of purification centres and dispatch centres. ';
Parts to date A to I are referred to as Parts B to J.
15. In Annex No 8, renumbered Part E, point 6, "100 kg 'is replaced by" 100 g'.
16. the following Annex 9 is inserted after Annex 8:

"Annex 9 to Decree No 381 / 2003 Coll.
INQUIRIES APPROVED FOR THE COLLECTION OF PATHOGENE MICROORGANISMS IN MEMBERS AND MARINE GAS
Treatment approved to inhibit the growth of pathogenic micro-organisms in bivalve molluscs and marine gastropods collected in the areas referred to in points 1 (b) and 1 (c) of Part A Annex No 8 to this Decree which has not been relayed or purified before marketing:
A. Sterilisation
Clams and marine gastropods may be sterilised in hermetically sealed containers (preserved) which comply with the requirements set out in point 4 of Section IV of Part D of Annex 6 thereto.
B. Other heat treatment
Unfrozen bivalve molluscs and marine gastropods in shell may be treated by the following methods:
1. immersion in boiling water for the period necessary to reach a temperature of at least 90 ° C within the mussel muscle and maintain that minimum temperature for at least 90 seconds;
2. by cooking for three to five minutes in a closed space where the temperature between 120 and 160 ° C is maintained and the pressure between 2 and 5 kg / cm2 followed by exfoliation and further freezing of the muscle to reach a core temperature of - 20 ° C,
3. by steam under pressure in a enclosed space where the requirements for the time and temperature within the mollusc muscle referred to in point 1 are met and where the uniform expansion of heat in the enclosed space is guaranteed by a validated methodology within the manufacturer's own control programme (HACCP). ';
