DECLARATION
of 26 June 2024
amending Decree No. 376 / 2011 Coll., implementing certain provisions of the Public Health Insurance Act, as amended by Decree No. 525 / 2021 Coll.
According to Section 39b (15) of Act No. 48 / 1997 Coll., on Public Health Insurance, and amending and supplementing certain related laws, as amended by Act No. 261 / 2007 Coll., Act No. 298 / 2011 Coll., Act No. 369 / 2011 Coll. and Act No. 371 / 2021 Coll.:
Decree No. 376 / 2011 Coll., implementing certain provisions of the Public Health Insurance Act, as amended by Decree No. 525 / 2021 Coll., is amended as follows:
1. In Article 33 (2), the words "in accordance with the second sentence of paragraph 1 'shall be inserted after the words" in accordance with the second sentence of paragraph 1' and, at the end of the text of paragraph 2, the words "or, in the case of medicinal products which do not have a restriction on use, the words" in the summary of product characteristics or in the Annex to the marketing authorisation in the case of medicinal products authorised in accordance with the procedure laid down in the directly applicable regulation of the European Union on the marketing of medicinal products, a doctor with specialised competence in the field of general medical practice, practical medicine for children and youth or pediatrics, which has a contract with the health insurance undertaking for this specialist. ';
2. In Paragraph 33 (3), the words "as referred to in paragraph 2 'are replaced by the words" than doctors with specialised competence with a designation of competence referred to in the prescription restriction referred to in paragraph 1, first sentence'.
Efficacy
This Decree shall take effect on 1 July 2024.
