ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 23 April 2020
on the adoption of crisis measures
Following the Government Resolution 194 of 12 March 2020, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, the Government declared emergency status in accordance with Article 5 and Article 5 (a) to (e) and Article 6 of Act No. 240 / 2000 Coll., on the grounds of health threats in connection with the detection of coronavirus / known as SARS CoV-2 / in the territory of the Czech Republic, and on emergency management and amending certain laws (Crisis Act), as amended, for the resolution of a crisis situation, the adoption of emergency measures, by virtue § 5 (c) and (e) and § 6 (b) respectively.
Government with effect from 27 April 2020 at 00am
I. prohibits
(a) retail sale and sale of services at premises, except:
- the sale of foodstuffs,
- fuel sales,
- fuel sales,
- the sale of sanitary goods, cosmetics and other drug products,
- pharmacies, dispensers and shops of medical devices,
- the sale of small domestic animals,
- the sale of feed and other animal needs,
- the sale of glasses, contact lenses and related goods,
- the sale of newspapers and magazines,
- the sale of tobacco products,
- laundry and dry cleaners services, not self-service laundry and dry cleaners,
- repair of road vehicles where there are not more than 30 persons at the same time in the establishment,
- towing and removal of in-service vehicle defects on the road,
- the sale of spare parts for means of transport and production technologies,
- establishments enabling goods and consignments to be collected from a third party,
- the sale of garden supplies, including seed and seed,
- ticket ticket sales,
- spa facilities, provided that only spa rehabilitation care is provided,
- funeral services,
- the sale of flowers,
- implementation and disposal of buildings, project activities under construction, geological work, surveying, testing, measurement and analysis in construction,
- the sale of textiles and textiles,
- computer and telecommunications technology, audio and video receivers, consumer electronics, devices and other household products,
- real estate intermediation and the activities of accountants, accounting, tax records,
- locksmiths, repairs, maintenance and installation of machinery and other household products,
- burial, embalming and preservation, cremation of human remains or human remains, including the storage of human remains in Urenas,
- car washing machines,
- sales of household goods, provided that respiratory protective equipment, such as respirator, mask, mouthpiece, scarf, scarf or other means are available at the premises to prevent the spread of droplets, gloves or disinfection,
- Hobbymarkets, construction and construction shops and hardware stores,
- the sale and servicing of bicycles,
- the collection and purchase of raw materials and composting plants,
- the sale of new and used road vehicles,
- craft, except establishments where the service provider contacts the customer's body surface (e.g. barbershop, hairdresser, pedicure, manicure),
- tourist information centres,
where the sale of the said goods or services constitutes a major part of the activity of the establishment;
(b) the presence of the public in food service establishments, with the exception of establishments which do not serve the public (e.g. occupational catering, catering of health service providers and social services, in prison facilities); This prohibition does not apply to sales outside the food service establishment (e.g. fast food establishments with a window or to the sale of food without entering the establishment);
(c) sales at catering establishments located within shopping centres with a sales area exceeding 5 000 m2;
(d) gambling and casino operations;
(e) the operation of a taxi service, with the exception of a food delivery service or persons authorised to drive a taxi service;
(f) the presence of the public at the premises of service providers - indoor sports sites, including indoor swimming pools, with the exception of gym, gym and fitness centres, for which the following rules are required:
i. limit the presence of clients so that they are at least 2 metres apart and have a maximum of 1 client for every 10 m2;
ii. cloakrooms and showers cannot be used,
ii. entry and exercise during the whole period with respiratory protection only,
i. ensure disinfecting machines and other training tools and equipment after use by each client;
v. continuously disinfect the places where clients occur,
vi. Ensure hand disinfecting for staff and clients,
vii. clients perform mandatory hand disinfection before and after the exercise has been completed,
viii. sell only bottled drinks and packaged food,
f.
x. individual training can only be performed in one-on-one mode,
x. in the halls for group exercises without personal contact, mark the training places in order to maintain the necessary distance between the individual practitioners at least 2 metres, each time with a maximum of 8 trainers and a maximum of 1 coach,
xii. adjust the timetable so that cleaning, ventilation and disinfection of the premises are carried out between the lessons;
(g) the sale of accommodation services, with the exception of persons providing accommodation in hostels, spa facilities and school accommodation facilities; This prohibition shall not apply to the sale and provision of accommodation services:
- persons for the purpose of pursuing a profession, business or other similar activity,
- foreigners until they leave the territory of the Czech Republic and foreigners with work permits in the territory of the Czech Republic,
- persons ordered by the public health authority to quarantine, and
- persons at risk of domestic violence;
(h) testing of clothing in clothing stores;
II. orders that the prohibition on retail sales referred to in Article I (a) shall not apply to:
(a) non-commercial activities under the Trade Act; or
(b) the sale of foodstuffs at establishments for which the sale of foodstuffs does not constitute a major part of the activity of the establishment in question, but the part of the establishment in which foodstuffs are sold is separated from the other parts of the establishment,
(c) establishments:
- the area accessible to the public does not exceed 2,500 m2; the size condition of the establishment is fulfilled even if an area not exceeding 2 500 m2 is defined and defined (e.g. by a boundary tape) for the public in an establishment of more than 2 500 m2; and
- which are not located within shopping centres with a sales area exceeding 5 000 m2; this condition is met even if the establishment is part of a shopping centre with a sales area exceeding 5 000 m2, but the public only enters the establishment from outside areas, not from the inner areas of the shopping centre; and
- not for establishments where the service provider contacts the customer's body surface (e.g. barbershop, hairdresser, pedicure, manicure),
(d) agricultural and other outdoor markets and markets for which the following rules are required:
- not to sell foodstuffs exclusively intended for immediate consumption,
- ensure distance between stands, tables or other points of sale of at least 2 metres,
- actively ensure that customers maintain a distance of at least 2 metres between themselves,
- to place containers containing disinfectants at each point of sale,
- to ensure that workers at points of sale wear gloves when in contact with goods and when receiving payments from customers,
- to sell goods without the possibility of tasting or consuming food and food or testing clothing on the spot;
III. Orders that
(a) the following rules have been complied with in establishments authorised to operate pursuant to Article I (a) and Article II (a) to (c):
- actively prevent customers from staying less than 2 metres away,
- to ensure the management of fronts of waiting customers, both inside and outside the establishment, in particular by means of the marking of the space for waiting and placing marks for minimum spacing of 2 metres between customers,
- to place disinfectants on frequently touched articles (mainly handles, railings, shopping carts) so that they are available to employees and customers of the premises and can be used for regular disinfection,
- ensure that workers at the premises wear gloves when in contact with goods and when receiving payments from customers,
- to ensure that customers are informed of the above rules, in particular through information posters at the entrance and at the premises and, where appropriate, by communicating the rules through loudspeakers at the premises;
(b) the sale of unpackaged pastries only took place under the following conditions:
- it is ensured that there is no accumulation of persons at the place where the pastries are taken,
- the place of sale is equipped with personal hygiene aids;
(c) entrepreneurs operating a retail food store with self-service sales provided disposable gloves or other similar protective equipment on their hands to customers free of charge at each entrance to such a store (e.g. a microthreaded bag);
(d) the following rules have been followed for the operation of driving schools and centres for improved driver training:
- theoretical instruction, consultation or indoor testing shall take place in the presence of a maximum of 5 persons and shall be at least 2 metres apart,
- at the entrance of the room, the person entering the room shall carry out hand disinfection, provided that the disinfectant is provided by the driver,
- the participant in the education is free from acute health problems consistent with viral infection (e.g. fever, cough, shortness of breath, sudden loss of taste and smell, etc.) and does not have quarantine measures at the time,
- there are no more than two persons present in the vehicle during practical instruction, each disinfecting hands before entering the vehicle, each having breathing protection throughout the whole period and after each journey the interior areas of the vehicle and the outer door handles are disinfected;
(e) the following rules have been followed for the operation of zoos, botanical gardens, arbores and similar operations, which can only be entered on the basis of a ticket:
- visitors will be able to buy only time tickets by remote access (on-line), without the possibility of buying them on-site,
- the number of visitors shall be limited in one day to not exceed 150 persons per hectare of the area of the establishment, internal pavilions and exposures shall be closed,
- the operator ensures increased disinfecting of the premises, distance between benches of at least four metres, avoidance of contact between visitors and animal-care staff,
- the operator shall ensure that measures are taken to prevent the accumulation of persons and to check compliance with minimum spacing in places where accumulation of persons can be expected, such as children's playground, toilets, rest zones, attractions, refreshment zones, etc.,
(f) the following rules have been followed for the operation of libraries:
- ensure that library staff wear gloves when in contact with books and other similar goods,
- at the entrance to the library, the customer carries out hand disinfection, provided that the library operator provides the disinfectant;
IV. Repeals the Government Resolution of 13 March 2020 No 208, issued under No. 80 / 2020 Coll.
