DECLARATION
of 10 June 2009
laying down the procedure for the publication of a selection procedure for a residential place, the course of the selection procedure for a residential place and the basic criteria for selecting a resident (about residential places)
The Ministry of Health (hereinafter referred to as "the Ministry ') provides, pursuant to Section 37 (1) (i) of Act No. 95 / 2004 Coll., on the conditions for obtaining and recognising professional competence and specialised competence for the pursuit of the medical profession of a physician, dental practitioner and pharmacist, as amended by Act No. 189 / 2008 Coll., and under Section 90 (2) (i) of Act No. 96 / 2004 Coll., as amended by Act No. 189 / 2008 Coll.:
Subject matter
This decree regulates the procedure for the publication of a tender for a residential place, the conduct of a selection for a residential place and the basic criteria for the selection of a resident.
The applicant for the selection procedure
For the purposes of this decree, the applicant for a tendering procedure (hereinafter referred to as "the applicant ') shall:
(a) an accredited establishment which has received a grant from the State Budget to a residential facility (1);
(b) an establishment which has received a subsidy from the State budget to the residential location (2).
Announcement of a selection procedure
(1) The applicant shall issue a tender for a residential site in a way that allows remote access. The applicant shall notify the announcement of the selection procedure in accordance with the sentence of the first Ministry, no later than 3 days after its publication.
(2) The invitation to tender shall contain:
(a) the designation "Selection procedure for a residential place,"
(b) the name and address of the applicant;
(c) a list of residences, including specialisation training;
(d) the deadline for the submission of applications (hereinafter referred to as the application) for the selection procedure; that period may not be less than 15 working days from the date of publication of the invitation to tender;
(e) the place for applying for the selection procedure;
(f) criteria for the evaluation of tenderers established by the applicant; the criteria must be objective and non-discriminatory,
(g) a list of the documents accompanying the application pursuant to Article 4 (2);
(h) the method of evaluation in accordance with the criteria referred to in point (f).
(3) A candidate shall be included in the selection procedure on the basis of the application submitted if the conditions set out in the tender notice and in this decree are met.
Application
(1) The application shall be submitted within the time limit and place specified in the invitation to tender.
(2) The application shall contain the particulars set out in Annex 1 thereto. The applicant shall provide evidence of the application
(a) a completed personal questionnaire, the particulars of which are set out in Annex 2 to this order;
(b) medical assessment of professional fitness which may not exceed 3 months;
(c) an extract from the Register of Penalties or an extract from a similar register which may not exceed 3 months;
(d) an uncertified copy of the document certifying the acquisition of competence;
(e) an uncertified copy of the proof of specialisation (3) or, if it has obtained it, of the specific competence;
(f) if the doctor, dentist or pharmacist is a certificate of inclusion in the relevant field of specialisation;
(g) an overview of professional experience.
(3) The documents referred to in paragraph 2 (b) and (c) shall not be submitted by a tenderer who is already an employee of the applicant.
Duration of the selection procedure
(1) The applicant shall set up a committee of at least three for each selection procedure; one of the members of this commission is the resident trainer. The members of the Commission shall be appointed and withdrawn by the applicant.
(2) Only a person may be a member of the Commission who, having regard to his or her relationship with the applicant, has no reasonable doubts as to his or her unbiased nature. The members of the Commission shall confirm this fact by a declaration of honour, which shall be based on the tender documents.
(3) Membership of the Commission is irreplaceable.
(1) A quorum shall be available to the Commission if at least half of the members of the Commission are present.
(2) The Commission shall elect an absolute majority of the members present by the President of the Commission, who shall be responsible for the work of the Commission and for the proper conduct of the selection procedure.
(3) The chairman of the commission shall inform the members of the commission of the content of the applications and shall manage the proceedings of the commission. The Commission shall evaluate the tenderers in accordance with the criteria laid down in the tender notice, their personal assumptions, knowledge and competence for the pursuit of the profession in the field concerned. After examination of the applications, the Commission may open personal interviews with the selected candidates.
(4) Upon completion of the personal interviews, the commission shall determine the ranking of the candidates. The order of candidates set by the commission shall be binding on the applicant.
(5) The Commission shall draw up a record of the progress and outcome of the selection procedure. The minutes shall include a report on the assessment and evaluation of tenderers for the place of residence, the content of which is set out in Annex 3 to this Order.
(6) The minutes shall be signed by the President and all members of the Commission present. The President of the Commission shall forward the minutes to the declarant without delay after the hearing of the Commission; the Commission's activities are terminated.
Termination of the selection procedure
(1) The selection procedure is closed by the selection of the resident. The applicant shall notify the tenderers in writing of the outcome of the selection procedure no later than 10 working days after the end of the selection procedure and shall transmit the list of selected residents to the Ministry without delay.
(2) The selection procedure is further closed,
(a) if no tenderer has applied within the prescribed time limit,
(b) if none of the tenderers fulfils the conditions laid down in the tender notice and in this decree,
(c) where accreditation has been withdrawn from the applicant; or
(d) if there is another element which makes it impossible to draw the subsidy to a residential place.
Documentation of the selection procedure
(1) The applicant shall keep a file on each selection procedure containing:
(a) the information given in the tender notice;
(b) applications for tenderers, including the documents referred to in Article 4 (2);
(c) a record of the progress and outcome of the selection procedure referred to in Article 6 (5);
(d) a declaration of honour pursuant to Article 5 (2).
(2) The documents referred to in paragraph 1 shall be deposited by the declarant for at least the duration of the specialised training of all residents of the relevant selection procedure.
Reimbursement of the costs of the selection procedure
The costs associated with the publication of the selection procedure and the costs associated with the activities of the commission shall be borne by the applicant.
Efficacy
This Decree shall take effect on 1 July 2009.
