GOVERNMENT REGULATION
of 25 June 1997
laying down technical requirements for construction products
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts (hereinafter referred to as "the Act") to implement Sections 12 (1) and (4) and 13 (2) and (4) of the Act:
(1) For the purposes of this Regulation:
(a) a construction product, each product designated by the manufacturer or importer for permanent incorporation into buildings, provided that it is covered by at least 1 of the technical requirements set out in Annex 1;
(b) the intended use of the product is related to the role the product has in meeting the technical requirements set out in Annex 1;
(c) permanent incorporation of the product into the construction of such an installation in which, by removing or replacing the product, the performance indicators of the construction and the removal or replacement of the product are constantly changed,
(d) the construction activity, the purpose of which is to implement the construction, its change or maintenance work, as appropriate.
(2) The products provided for in Article 12 (1) of the Act are those listed in Annex 2 (hereinafter referred to as "products").
(1) The technical requirements for products are set out in Annex No 1 (hereinafter referred to as "essential requirements").
(2) Where the essential requirements are specified by harmonised Czech technical standards (Section 4 (4) of the Act) and the characteristics of the product comply with them, these essential requirements shall be deemed to be met.
(3) Where a manufacturer or importer intends to place on the market a product the characteristics of which do not comply with harmonised Czech technical standards or where such standards do not specify the essential requirements referred to in paragraph 1 which apply to the products in question, the manufacturer or importer shall ensure an assessment of the technical characteristics of the sample (prototype) of the product authorised by the person in accordance with § 3. On the basis of that assessment, the authorised person shall issue a certificate (hereinafter referred to as the "construction technical certificate ') certifying the suitability of the technical characteristics of the products in relation to the essential requirements for construction according to the role to be played in the construction.
(4) The manufacturer or importer shall carry out, or ensure, conformity assessment of products with the essential requirements ("conformity assessment ') in accordance with the conformity assessment procedure indicated for each product in Annex 2.
(5) Where a harmonised Czech technical standard transposing a harmonised European standard sets out a specific conformity assessment procedure, the manufacturer or importer shall carry out or ensure conformity assessment by that specific procedure.
(6) In cases of unit production, manufacturers or importers may, instead of the conformity assessment procedures referred to in paragraph 4, provide for conformity assessment in accordance with the procedure laid down in Section 8, unless otherwise specified in the harmonised Czech technical standard transposing the harmonised European standard.
Part-time production means the single production of products, regardless of the number of pieces produced, in particular the craft production of products intended primarily for protected buildings or for the repair and maintenance of buildings, which are not expected to repeat production of a type of the like product. Any recurrence of production or import of a type of the like product, including for imported products, is no longer considered to be a unit production.
(1) In order to assess the characteristics of a sample (prototype) of a product authorised by a person in the cases referred to in Section 2 (3), the manufacturer or importer shall provide the authorised person with the necessary supporting documents or, where appropriate, samples of the product or the results of previous verification tests and sample assessments. The manufacturer or importer shall at the same time submit a written declaration that the assessment of the characteristics of the sample (prototype) of the product has not been agreed with another authorised person.
(2) Authorised person shall:
(a) an assessment of the supporting documents submitted by the manufacturer or importer, in particular for the identification of the product and its characteristics;
(b) an assessment of the technical characteristics of the product and its level in view of the intended use of the product in construction, in terms of other technical regulations, (1) Czech technical standards and on the basis of scientific, technical and practical knowledge;
(c) verification tests and evaluation of samples of the product, if any.
(3) On the basis of those assessments or tests, the authorised person shall issue a construction technical certificate with a limited period of validity. This period may be extended.
(4) The construction technical certificate shall contain:
(a) identification details of the manufacturer or importer (name and surname, residence, place of business and natural person identification number or business name, registered office and legal person identification number),
(b) identification and description of the product;
(c) the definition of the method of use of the product in the construction site, including any restrictions;
(d) an overview of the supporting documents submitted by the manufacturer or importer;
(e) an overview of the technical regulations and technical standards applied and of any other evidence of the state of scientific and technical knowledge;
(f) details of the technical characteristics of the product, their level and their methods of detection;
(g) specifying the requirements for the assessment of products and for the assessment of the quality system in terms of production control (hereinafter referred to as the "quality system") in conformity assessment,
(h) the period of validity of the construction technical certificate.
(1) For conformity assessment, the manufacturer or importer shall obtain technical documentation.
(2) The technical documentation must be of such an extent as to allow conformity assessment of the product with harmonised Czech technical standards or with a construction technical certificate or with technical regulations.
(3) The technical documentation, taking into account the nature of the product, contains:
(a) a detailed description of the product and the definition of its use in construction;
(b) for imported products, identification details of their producer;
(c) a reference to harmonised Czech technical standards or construction technical certificates (hereinafter referred to as "technical specifications") to be used for conformity assessment after production or import,
(d) design and production drawings of the product, the technological process for its production and for construction use, the technical characteristics of the product relating to the essential requirements;
(e) descriptions and explanations necessary to understand the drawings and functions of the product, instructions for use in the construction and, where appropriate, warnings; warning of danger or restriction of use and instructions for safe use must be in the Czech language,
(f) the results of design and design calculations and tests carried out;
(g) test reports and, where appropriate, certificates.
(1) For product certification, the manufacturer or importer shall provide the authorised person:
(a) their identification details (name and surname, place of residence, place of business and the identification number of the natural person or business name, registered office and identification number of the legal person), for the imported products also an indication of the place of manufacture;
(b) technical documentation to the extent referred to in Article 4 (3);
(c) samples of the product,
(d) a description of the quality system or, where appropriate, of the products imported, a description of the method of checking the products by the importer.
(2) The authorised person shall carry out the product certification by:
(a) examine the supporting documents submitted by the manufacturer or importer and assess whether they comply with the requirements of this Regulation;
(b) test the sample or samples of the product and verify that the product does not endanger the health or safety of persons, property or natural environment and that it meets the characteristics set out in the technical specification and, where appropriate, in the technical regulations;
(c) carry out an assessment of the quality system, whether it conforms to the relevant technical documentation and whether the quality system ensures that products placed on the market conform to the technical specification; where, for imported products, the importer does not provide an assessment of the quality system with a foreign manufacturer authorised by the person, the importer shall be the subject of an assessment of the method of control of the products.
(3) Where the sample complies with the technical specification and the technical regulations and the manufacturer ensures the proper functioning of the quality system and, where appropriate, the importer ensures proper control of the products by the importer, the authorised person shall issue a product certificate and transmit it to the manufacturer or importer. This certificate shall contain the conclusions of the detection, verification and test results, the description and, where appropriate, the representation of the certified product necessary for its identification.
(4) The authorised person shall supervise the proper functioning of the quality system with the manufacturer or check the products with the importer, or carry out random checks on compliance with the requirements laid down for the products. The authorised person shall issue a report on the assessment of the supervision and, where appropriate, the checks, which shall be transmitted by the manufacturer or importer.
(1) For the assessment of the quality system of the manufacturer or importer
(a) carry out or have tested a product type (sample) and assess whether the product type complies with the technical specification; evidence of the results of the tests and their assessment shall be drawn up,
(b) provide technical documentation to the extent referred to in Article 4 (3);
(c) ensure that all products placed on the market comply with the technical documentation referred to in Article 4 (3);
(d) provide the authorised person with an assessment of the quality system operated by him in accordance with paragraph 3, for which he shall provide the necessary supporting documents.
(2) Authorised person
(a) carry out an assessment of the quality system, whether it conforms to the relevant technical documentation and ensures that products placed on the market comply with the technical specification; these requirements are deemed to be met if Czech technical standards are applied in production (2) for quality assurance models;
(b) where the quality system ensures that products placed on the market comply with the technical specification, it shall issue a certificate thereof,
(c) supervise the quality system and issue a report on the results.
(3) Where the manufacturer or importer fails to demonstrate all the facts referred to in paragraph 2 or it is not possible to fulfil the tasks of the authorised person referred to in paragraph 3, the conformity assessment shall be carried out in accordance with the procedure laid down in Article 5.
(1) To verify the conformity of products by the manufacturer or importer
(a) ensure that the product type (sample) is tested and the conformity assessment of the product type with the technical specification is carried out by an authorised person;
(b) provide technical documentation to the extent referred to in Article 4 (3);
(c) ensure that all products which it places on the market comply with the technical documentation referred to in Article 4 (3); the importer ensures to an appropriate extent the control of the imported products.
(2) The authorised person shall carry out the product type (sample) tests and assess whether the product type complies with the technical specification. It shall issue a report on the results of the tests and their assessment, indicating the period of validity.
(1) For conformity assessment by the manufacturer or importer
(a) carry out or have tested a product type (sample) and assess whether the product type complies with the technical specification; evidence of the results of the tests and their assessment,
(b) provide technical documentation to the extent referred to in Article 4 (3);
(c) ensure that all products which it places on the market comply with the technical documentation referred to in Article 4 (3); the importer ensures to an appropriate extent the control of the imported products.
(2) Where an importer does not ensure that all the provisions of paragraph 2 are complied with, the conformity assessment shall be carried out in accordance with Section 7.
The conformity assessment procedure referred to in Article 5 may replace the conformity assessment procedures referred to in paragraphs 6 to 8.
The evidence of the conformity assessment procedure used pursuant to Article 13 (4) of the Act shall include technical documentation and documents drawn up in conformity assessment.
(1) The declaration of conformity shall be drawn up in the Czech language and shall contain the following particulars:
(a) identification details of the manufacturer or importer issuing the certificate of conformity (name and surname, residence, place of business and identification number of the natural person or trade name, registered office and legal entity identification number),
(b) product identification data (e.g. name, type, brand, design), for imported products the name and address of the manufacturer and the place of manufacture;
(c) description and designation of the product (manufacturer or importer designated for the purpose of use in construction), other data on the product, e.g. toxicity, degree of flammable,
(d) an indication of the method of conformity assessment used; identification of test evidence and conformity assessment,
(e) a list of technical regulations (Section 3 of the Act) and of Czech technical standards used in conformity assessment;
(f) where the authorised person has issued a construction technical certificate or has participated in the conformity assessment, the details of that person (trade name, registered office, identification number of the authorized person) and the registration number and date of issue of his or her finding (construction technical certificate, test report or certificate, as appropriate) of the product concerned or of the assessment of the quality system of production;
(g) a confirmation by the manufacturer or importer that the characteristics of the product comply with the essential requirements of this Regulation and, where appropriate, with other technical regulations, that the product is safe under normal conditions and, where appropriate, by the manufacturer or importer of the intended use, and that he has taken measures to ensure compliance of all products placed on the market with the technical documentation and with the essential requirements;
(h) the date and place of issue of the certificate of conformity; the name and function of the responsible person of the manufacturer or importer and its signature.
(2) Where there is a change in the facts on which a declaration of conformity has been issued for a product which is to continue to be placed on the market after that change and where that change may affect the characteristics of the product from the aspects of the essential requirements, the manufacturer or importer shall issue a new declaration of conformity. Other changes to the facts on which the certificate of conformity was issued shall be indicated in the addendum to the certificate of conformity.
(1) Products which will be placed on the market after the entry into force of this Regulation by 30 June 1998 may meet only the technical requirements applicable under the legislation in force before the entry into force of this Regulation.
(2) For products listed in Annexes No 2, 3 and 4 which will be placed on the market after the entry into force of this Regulation by 30 June 1998, the manufacturer or importer may ensure that conformity assessment is carried out only in accordance with Article 8.
(3) For products which will be placed on the market during the period from the entry into force of this Regulation until 31 December 1997, their producer or importer may obtain the technical documentation referred to in Article 4 (3) (b) and (e) retrospectively and by 31 December 1997 at the latest.
(4) Until 30 June 1998, the construction technical certificate may be replaced by the technical documentation referred to in Section 4.
This Regulation shall enter into force on 1 September 1997.

ESSENTIAL REQUIREMENTS
The products as a whole and their individual parts must be suitable for the intended use in the construction, while respecting the economy.
The products shall have characteristics such that, where they have been properly designed, constructed and maintained, the construction works meet the following requirements:
1. Mechanical resistance and stability
The construction must be designed and constructed in such a way that the loads likely to affect it during construction and use do not result in:
(a) the collapse of the whole or part of the structure;
(b) a higher degree of unacceptable reformation;
(c) damage to other parts of the structure or equipment connected to the construction or installation of the installation due to deformation of the structure;
(d) damage to events to an extent disproportionate to the original cause.
2. Fire safety
The construction shall be designed and constructed in such a way that in the event of a fire:
(a) the loading capacity and stability of the structure are maintained for a certain period of time;
(b) the development and spread of fire and smoke in the building site is limited;
(c) the spread of fire to adjacent objects is limited;
(d) persons and evacuable animals may have left the building or been rescued by other means;
(e) the safety of rescue units has been taken into account.
3. Hygiene, Health and Environment Protection
The construction shall be designed and constructed in such a way that it does not endanger the hygiene or health of its users or neighbours, in particular as a result of:
(a) the discharge of toxic gases;
(b) the presence of hazardous particles or gases in the air;
(c) emission of hazardous radiation;
(d) pollution or contamination of water or soil;
(e) insufficient disposal of waste water, smoke and solid or liquid waste;
(f) the presence of moisture in construction structures or on surfaces within the construction.
4. Safety while using
The construction must be designed and constructed in such a way that, when it is used or operated, there is no unacceptable risk of injury such as slipping, skid, falling, impact, burn, electric current, explosion.
5. Noise protection
The construction must be designed and constructed in such a way that the noise perceived by residents or persons near the construction is maintained at a level that does not jeopardise their health and allows them to sleep, rest and work in satisfactory conditions.
6. Energy saving and heat protection
The construction and its heating, cooling and ventilation facilities shall be designed and constructed in such a way that the volume of energy consumed during operation is low in relation to the climatic conditions of the site and user requirements.
These requirements shall be met during normal maintenance in an economically reasonable period of time, provided that the effects of the normally foreseeable effects on the buildings are present. The product shall maintain the technical characteristics for its economically reasonable service life, i.e. as long as the performance characteristics of the construction are maintained at a level compatible with the performance of the above construction requirements.
