DECLARATION
of 2 April 2004
on the manner and extent of data demand by the Research Institute of the Agricultural Economy
The Ministry of Agriculture provides, pursuant to Article 4 (3) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., hereinafter referred to as "the Act":
Subject matter
This decree regulates, on the basis of the law and the immediately binding laws of the European Communities (1) (hereinafter referred to as the "European Communities' Regulations'), the manner and scope of data requirements by the Research Institute of the Agricultural Economy (hereinafter referred to as the" entrusted person ') of economic operators governed by the Act on State Statistical Service2 (hereinafter referred to as "economic operators').
Method and scope of data requirement by the delegate
(1) An authorised person who is the contact point of the FADN Farm Accountancy Data Network on the basis of European Communityrules (3) shall be entitled to require from the economic operator on the basis of European Community1) the data referred to in paragraphs 2 and 3 for the previous calendar year by 31 March of the following calendar year, in a manner enabling remote access.
(2) The delegate may, in accordance with paragraph 1, require the economic operator keeping the register (4)
(a) his identity;
(b) the agricultural land used by him;
(c) his staff;
(d) his orbital assets;
(e) its revenue attributable to it and not attributable to the tax base,
(f) its expenditure attributable to and not attributable to the tax base;
(g) his long-term tangible and intangible assets,
(h) his obligations and sources of cover;
(i) its animal and plant production;
(j) its secondary livestock and plant production and its other production;
(k) the subsidies and aid received.
(3) The delegate may, in accordance with paragraph 1, require the economic operator keeping the accounts (5)
(a) his identity;
(b) the agricultural land used by him;
(c) his staff;
(d) his accounts as at 31 December of the calendar year,
(e) his long-term tangible and intangible assets,
(f) its animal and plant production,
(g) its secondary animal and vegetable production and its other production;
(h) the subsidies and aid received.
(4) The person responsible for handling the personal data of natural persons shall comply with specific legislation. 6)
Efficacy
This decree shall take effect on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
