DECLARATION
of 1 July 2015
on the food recipient's information obligation at the place of destination
The Ministry of Agriculture provides, pursuant to Article 18 (1) (f) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related acts, as amended by Act No. 139 / 2014 Coll.:
Subject matter
(1) This decree regulates the scope of the information obligations of the food business operator at the place of destination (hereinafter referred to as "the food recipient at the place of destination ') following the directly applicable European Union Regulation.
(2) This Order applies to:
(a) apples,
(b) early potatoes and late potatoes,
(c) poppy seed 5),
(d) dietary supplements (6),
(e) food of animal origin (7) except:
1. fresh fishery products, live bivalve molluscs, gastropods, echinoderms and tunicates intended for human consumption;
2. collagen and natural and collagen intestines intended for food production;
3rd honey.
(3) This decree shall apply only where the destination is the place of first reception, including any first treatment or handling in the territory of the Czech Republic of the food referred to in paragraph 2.
Scope of information obligations, deadline and means of transmission
(1) The food recipient from another Member State of the European Union or a third country at the place of destination, if the food referred to in points (a) to (d) of Paragraph 1 (2) and the destination referred to in paragraph 3 of Article 1, shall notify the State Agricultural and Food Inspection Information System no later than 24 hours before the food arrives at the place of destination
(a) the type of food coming to its destination;
(b) the quantity of food arriving at the place of destination;
(c) the Member State of the European Union or a third country, the name and address of the food business operator supplying the food to the place of destination,
(d) the name, address and identification number of the destination and the consignee of the food at the place of destination; and
(e) the date of arrival of the food at the place of destination.
(2) The consignee of food from another Member State of the European Union at the place of destination, if the food referred to in Article 1 (2) (e) and the destination referred to in Article 1 (3) is concerned, shall notify, through the information system of the State Veterinary Administration, at the latest 24 hours before the food arrives at the place of destination
(a) the type of food coming to its destination;
(b) the quantity of food arriving at the place of destination;
(c) the physical state or manner of treatment of the food arriving at the place of destination;
(d) the Member State of the European Union, the name and address of the food business operator supplying the food to the place of destination, including the approval or registration number (8), where it has been allocated by the competent supervisory authority;
(e) the address of the place of destination and the consignee of the food at the place of destination, including the approval or registration number, provided that the competent supervisory authority has been allocated (8); and
(f) the date of arrival of the food at the place of destination.
Repeal
Decree No. 320 / 2014 Coll., on the information obligation of the food recipient at the place of destination in relation to certain food species, is repealed.
Efficacy
This Decree shall take effect on 1 August 2015.
