GOVERNMENT REGULATION
of 7 January 2004
on rules for granting subsidies to zoo operators
The Government mandates pursuant to § 18 of Act No. 162 / 2003 Coll., on the conditions for the operation of zoos and on the amendment of certain laws (the Law on Zoos) (hereinafter referred to as "the Act") to implement § 14 (3) of the Act:
§ 1
Subject matter
(1) This Regulation lays down rules on the granting of subsidies from the State budget to zoo operators (hereinafter referred to as "subsidies') for activities and projects the object of which is defined in the Annex to this Regulation.
(2) This Regulation shall not apply to the grant of grants for science and research projects pursuant to Article 14 (1) (f) of the Act governed by special legislation.1)
Rules for granting subsidies
§ 2
The subsidy may be granted if the zoo operator (the applicant):
(a) holds a valid licence issued under the law;
(b) on the date on which the application for a subsidy (hereinafter referred to as "the application") is submitted, there shall be no arrears in respect of the state budget, the state funds or the budget of the local authority, and arrears in respect of insurance premiums for public health insurance, social security premiums and contributions to the state employment policy;
(c) is not in liquidation or his property has not been declared bankrupt or the application for bankruptcy has not been rejected for lack of assets;
(d) does not draw on the subsidy for the same activities and projects under this Regulation in the framework of subsidies granted by the Ministry of the Environment (hereinafter referred to as "the Ministry"), the State Fund for the Environment and, where appropriate, other sources of the State Budget; and
(e) make proper financial settlement of subsidies granted to it in previous years.
§ 3
(1) The application contains:
(a) the business name or name, identification number, if assigned, registered and legal form of the applicant, followed by the name and, where appropriate, the name, surname, date of birth and address of the place of permanent residence of the authorised representative,
(b) the name and, where applicable, the name, surname, address of the applicant's place of residence and the applicant's identification number, if any, if any, if any, is assigned to a natural person;
(c) proof of the legal personality of the applicant, if any,
(d) the reference number under which the licence was issued under the law;
(e) banking links;
(f) the applicant's tax identification number, if assigned;
(g) the telephone and fax numbers and, where appropriate, the applicant's electronic address;
(h) the amount of subsidy required.
(2) The Annex to the application contains:
(a) a detailed description of the project or activity to which the subsidy is requested, including the expected benefit;
(b) justification for the purpose and amount of the subsidy requested;
(c) a detailed budget for the project or activities;
(d) a declaration of the applicant's participation in the implementation of the project;
(e) an affidavit of the applicant to fulfil the conditions laid down in § 2 (1) (b) to (e).
(3) The application shall be submitted to the Ministry in writing by 30 April of the calendar year in which the subsidy is to be granted.
§ 4
Applications shall be examined by the Commission for Zoos (hereinafter referred to as "the Commission ') and shall be decided by the Ministry, which shall evaluate:
(a) the quality of the project and its expected contribution;
(b) the adequacy of the budgetary costs for each activity.
§ 5
(1) On the basis of the outcome of the selection procedure, the Ministry shall, no later than 15 July of the calendar year in which the grant is to be granted, issue a decision to grant the grant under specific legislation, 2) until the funds for the financial year are exhausted. The order recommended by the Commission shall be taken into account when deciding on applications.
(2) The grant may be granted up to 80% of the budgeted project implementation costs.
(3) The subsidy shall be granted by the Ministry at the dates specified in the decision granting the subsidy based on the nature of the project or activity.
Common, transitional and final provisions
§ 6
(1) The beneficiary shall be responsible for the economic use of the subsidy provided in accordance with the conditions laid down in the decision granting the subsidy and for the proper settlement of the subsidy. Failure to comply with the conditions for granting the subsidy is a breach of budgetary discipline under a special legislature.3)
(2) Specific legislation is in force for checking compliance with the conditions for drawing the subsidy, for the withdrawal procedure and for the application of penalties for breaches of budgetary discipline in the management of the subsidy.
(3) The subsidy does not cover routine repairs, maintenance of the zoo and wage expenses related to the implementation of the project.
(4) The legal relationship between the Ministry and the beneficiary resulting from the grant of subsidies before the date of entry into force of this Regulation shall be governed by existing legislation.
§ 7
Efficacy
This Regulation shall enter into force on 15 January 2004.

Definition of project subjects and activities
The object of the aid is:
1. Breeding endangered species of world fauna in Czech zoos
1.1 Breeding of endangered species of world fauna included in the European Conservation Programmes (EEP).
1.2 The breeding of endangered species of world fauna within European breeding books (ESB).
1.3 The breeding of endangered species of world fauna in international breeding books (ISB).
1.4 The breeding of endangered species of the world fauna referred to in the red book IUCN (RBD) and species of the world fauna is difficult to keep in human care.
1.5 Breeding of selected endangered species of world fauna protected under special legislation. 5)
1.6 Participation in reintroduction programmes of endangered species of world fauna.
1.7 Construction and reconstruction of the zoological garden for the breeding of endangered species of world fauna according to points 1.1 to 1.6.
2. Involvement of Czech zoological gardens in the nature conservation system of the Czech Republic
2.1. Care for specially protected animals collected under specific legislation. 6)
2.2 Care of specially protected animals under special legislation, 7) adopted from the wild, temporarily or permanently incapacitated, in nature.
2.3 Breeding of specially protected animal species under special legislation7) and involving the zoo in rescue programmes on selected species of these animals.
2.4 Construction and reconstruction of zoological garden buildings for breeding and care of specially protected animals according to points 2.1 to 2.3.
2.5 Breeding rare and dying breeds of domestic animals to save their unique genomes.
2.6 Involvement in inventory surveys and research of specially protected species of animals under special legislation (7) for the conservation of nature.
2.7 Implementation of training programmes and participation in public education and education in the field of nature conservation, particularly within the meaning of the Convention on Biological Diversity (8), and related publication activities.
3. Cooperation of Czech zoos in international programmes of endangered species breeding with significant zoos and institutions abroad, promotion of membership and participation of Czech zoos in international organisations
3.1 Contribution to the membership and participation of Czech zoos in international organisations:
the World Association of Zoos and Aquaria WAZA,
European Endangered Species Breeding Programmes EEA,
the European Association of Zoos and Aquaria EAZA,
International Association of ZOO Educators IZE,
International Species Information System (ISIS),
the Eurasian Regional Association of ZOOs and Aquaria ERAZA,
Captive breeding specialists group CBSG.
3.2 Cooperation of Czech zoological gardens with significant zoos, institutions and organisations abroad in the coordination of international programmes for the breeding of endangered species and the performance of the tasks of zoos referred to in points 1.1 to 1.6.
3.3 Issue and distribution of international, European and national breeding books of selected endangered species, in the framework of international cooperation.
3.4 Issue and distribution of the "Year of the Union of Czech and Slovak Zoos" which shows changes in the state of animals kept in the zoos of the Czech Republic from 1 January to 31 December of the calendar year.
