on the full text of the Decree of 5 March 1927, No. 15 Coll., on the regulation of the pay and certain service conditions of Czechoslovak national rail employees.
Pursuant to Article 22 of the Decree of 28 May 1946, No 146 Coll., amending and supplementing the Decree of 5 March 1927, No 15 Coll., on the modification of the pay and certain service conditions of Czechoslovak public rail employees, I amend and publish in the Annex to the Decree the full text of Decree No. 15 / 1927 Coll., as is apparent from the later regulations, the amendments are changing and complementary.

concerning the arrangements for the payment and certain service conditions of Czechoslovak State Railways employees, as amended by the Government Regulations of 13 December 1940, No 444 and No 445 Coll., of 28 May 1946, No 146 Coll., and the Transport Minister's Order of 11 July 1942, No 256 Coll., and of 19 September 1944, No 215 Coll.
The Government of the Czechoslovak Republic hereby orders pursuant to Section 210 of the Act of 24 June 1926, No. 103 Coll., on the modification of the pay and certain service conditions of civil servants (Law of 24 June 1926):
Initial provision.
(1) The first part of this Regulation shall apply to officials and sub-officials and founders of national railways, namely:
I. part for officials,
Part III for sub-officials and administrators; and
Part IV to Part VI for all employees covered by the provisions of the preceding parts, unless otherwise provided for in this Regulation.
(2) The second part of this Regulation applies to auxiliary staff of the Member States. The designation "Auxiliary staff 'shall take place at the place of the existing designation" Auxiliary staff, Auxiliary officers, Auxiliary officers, Office manuals, Office Auxiliary Forces and Permanent Workers'.
(3) Unless otherwise provided for in this Regulation, its provisions shall apply to the staff members referred to in paragraphs 1 and 2, irrespective of gender.
(4) The private-law nature of the service of employees of the national rail sector is not affected by this Regulation.
(5) Staff members whose pay and service conditions are governed by specific service or employment contracts shall not be subject to the provisions of this Regulation.

Officials.
Official categories and service classes.
(1) The following official categories shall be established for the provision of official service activities on national rail sections and the following pre-education shall be prescribed for the provisions therein:

9. nižší pomocné technické služby jiné vyšší předběžné vzdělání, než podává obecná škola
10. nižší pomocné provozní a administrativní služby jiné vyšší předběžné vzdělání, než podává obecná škola
(2) In the light of the preliminary training prescribed for the provision in which category the official posts in the service class shall be classified as follows:
(a) Ib is a post of official category in which it is principally prescribed as a pre-education of full secondary education and at least four years of higher education, completed with successful performance of prescribed state or, where appropriate, strict examinations;
(b) in the service class IC, posts of official categories in which the provision is essentially prescribed as a pre-secondary education and less than four years old but at least two years of comprehensive higher education completed by successful performance of state or, where appropriate, strict examinations, in a university;
(c) to the post of official category II in which the provision is essentially prescribed as a pre-education in secondary school;
(d) a post of official category III in which, for the purposes of the provisions, it is principally prescribed as a preliminary education for the completion of four lower secondary school classes or a one-year course associated with a civil school (in the official category of auxiliary technical services in both cases, the successful performance of a special vocational examination) or the completion of a civil school and at least two years of vocational school;
(e) to the service class IV of the post of official categories in which provision is essentially prescribed as a preliminary education other than that of a general school.
(3) According to this, the categories of officials of legal, technical and health classes Ib, the categories of officials of measuring classes Ic, the categories of officials of higher auxiliary technical services and of officials of operational and administrative services of service II, the categories of officials of auxiliary technical services and the categories of officials of auxiliary operational and administrative services of service III, and the categories of officials of lower auxiliary technical services and of officials of lower operational and administrative services of service IV.
(1) The category of auxiliary technical service officials shall include staff engaged in the following services of existing railway hauliers outside the service classes and sub-officials:
(a) building masters, craftsmen, bridge masters, signaling masters, train masters and track masters;
(b) drivers, vehicle repairers, garage masters, bus drivers and freight trains for road motor transport.
(2) The category of officials of auxiliary operational and administrative services includes staff performing services of the current service category of operating officials and services of car and train inspectors.
(3) The category of officials of the lower auxiliary technical services includes staff serving workshop services, works electricians, work bridge services, work telegraph services, work printing services, work line services, crane masters in river shipping sites, roadmasters, senior signaling officers and senior motor dressing drivers.
(4) The category of officials of the lower auxiliary operational and administrative services includes staff engaged in the service of operating masters, storerooms, heating masters, station masters, train masters and upper railway guards.
(5) Train inspectors are added from the train masters, from the wagon inspectors from the train masters. In doing so, they shall be provided for in accordance with the principles applicable to determining the service of promotion.
(6) Gardeners and drivers of road transport buses and freight trains are added from sub-officials of the Ia scale who have actually spent at least six years of service in the characteristics of a sub-official. In doing so, they shall be provided for in accordance with the principles applicable to determining the service of promotion.
(7) The official service posts of the 4th working class of the workshop, of the works electricians, of the works of the bridge services, of the works telegraph services, of the works printing services, of the works line service, of the crane masters in the river crossings, of the roadmasters, of the senior signaling officers, of the chief drivers of motor dressing, of the operating masters, of the storerooms, of the heating masters, of the station, of the train masters and of the upper railway officers shall be lent to subofficials of the pay scale Ia permanent performance of the service on the ground organised for the IV service class, who have actually spent at least six years of service in the subofficer's characteristics. In doing so, they shall be provided for in accordance with the rules applicable to determining the service of promotion.
Systemisation of service posts.
(1) The official posts shall be systemised according to their importance and taking into account the manner of service within the set normal needs of the forces in six scales,
post Ib of the service class in the 2nd to 6th scale,
place of IC service class in the 3rd to 6th scale,
post II of the service class in the 3rd to 7th scale,
third-class posts in the 4th to 7th scale,
the fourth-to-seventh-grader grade IV.
(2) Systemisation of posts shall be carried out separately for each individual official category and require the approval of the Government.
Officials may only be appointed to systematic posts. It shall be prohibited to lend a post of service which is not properly systemised or empty or to lend a post of service systemised for another official category without the simultaneous transfer of an official to that category. Nor is it permitted to lend a post on a higher salary scale to a post systemised in a lower salary scale.
The provisions of the expectant. Waiting period.
(1) Only those who have fulfilled the general conditions laid down for the provision by the official and, where applicable, the special conditions laid down for the provision by the candidate in the relevant official category and in the field of service may be designated by the latter.
(2) If this proves necessary, official aspirants may be appointed from among whom official candidates shall be added; the service and pay ratios of such aspirants shall be adjusted by a special government regulation.
(3) The provisions of the candidate shall be permitted only if there is a vacant systematic post in the relevant official category. Each candidate is bound by one systemized service post.
(4) With the exceptions set out in paragraph 6, as well as in Paragraph 2a (5) - (7), only those who have actually spent a specified waiting period in the official category in which they are to be designated may be appointed an official.
(5) A waiting period of three years, service class III.
(6) For particularly serious service reasons, the Government may, on a case-by-case basis, authorise the consent of the Ministry of Transport and the Ministry of Finance to allow waiting periods to be shortened or waived. This right is for the Ministry of Transport, if the official to whom the salary law applies is to be taken over in an official category of the same or lower grade. The Ministry of Transport may also authorise the waiting period to be reduced by the duration of the waiting period in the official category of the same or higher service in the service relationship covered by the salary law.
(7) The provisions of this Regulation on officials shall apply, unless otherwise specified, to officials who are waiting.
The waiting salary.
(1) Unless otherwise provided for in this Regulation, the candidate shall be entitled as an adjutum and education salary (§ 11).
(2) The adjutum of civil servants shall be measured according to the service classes and groups of places A, B, C, D (§ 10) and shall be determined in annual amounts as follows:

(3) Paragraph 10 (4) and (5) applies mutatis mutandis.
(4) The adjutum is increased once the candidate has actually spent half of the required waiting period in the official category in which it is to be established; by this half, the Ministry of Transport may take into account the period by which the waiting period has been shortened in accordance with the third sentence of Section 5, paragraph 6. Paragraph 14 also applies to the increase of adjute.
The provisions of the Waiver by the official.
(1) The candidate shall be appointed by an official as soon as he has completed, in respect of the member of the national rail, the waiting period laid down in the official category in which he is to be designated and has complied with the general conditions laid down for the provision by the official and the special conditions laid down for the provision by the official in the relevant official category and the service sector.
(2) The provisions on the exclusion or deferral and the period of effectiveness of the increase in the official's service (§ 14) apply mutatis mutandis to the provisions of the candidate by the official.
Official salary.
The official's salary shall consist of a service, an activity and an education fee.

(2) In the case of officials in service positions of the service class Ic, the sixth scale shall be preceded by the sixth scale as the initial degree of service of the service of 18.360 Kns per year.
Business.
(1) Operating fees shall be charged according to the service classes and scales and according to the municipality in which the permanent post of office of the official is established.
(2) The municipalities are included in four groups of places (A, B, C, D) and are subject to the provisions of Section 12 of the Law on the basis of which the Government Regulations are issued.
(3) The annual amounts of officials in business shall be as follows:

Officials at service post Ic shall be responsible for the initial degree of service of the sixth scale of the scale of service, as laid down for the sixth scale of service.
(4) An official with an active group of places D, who is forced to have a child on whom he is entitled to education (§ 63) and who is living with him in the same household, to stay in an apartment for the purposes of school or other vocational training outside his place of residence, belongs until the end of that education, including for holidays, which are carried out according to the category C.
(5) Officials whose permanent place of employment is outside the territory of the Czechoslovak Republic are entitled to an operating fee according to the category of seats A.
The educational fees are for each unprovided child (§ 63) of the annual 1800 CZK.
First or again provision by the official.
(1) Unless otherwise provided for in this Regulation, the official shall receive, at the first or again provision of the initial service of the relevant lowest scale.
(2) For particularly serious service reasons, the Government may allow deviations to be accepted by the Ministry of Transport and the Ministry of Finance for a proposal.
Increase in service.
(1) The service shall be increased in all scales in accordance with a higher degree procedure and in the fifth to seventh scales by the service allowances of the relevant service class.
(2) An increase in the duty rate shall take place as soon as the official has completed three years of deductible service hours with the service level immediately preceding the same scale.
(3) The increase in the first allowance shall take place as soon as the official has completed three years of deductible service hours with the highest grade of the scale concerned. An increase in each additional allowance shall take place as soon as the official has completed three years of deductible service hours with the most recently obtained allowance of the same salary scale. An increase in the last allowance shall be excluded if the official has completed 35 years of service attributable to the provisions of the official and to the increase in service.
(4) The period of four years shall be four years at service posts in the service class IC.
(5) The increase in the service shall be made ex officio.
Exclusion and postponement of the increase in service.
Unless otherwise provided for in this Regulation, this Regulation shall apply to the exclusion, as regards the deferral of increases in official duties under this Regulation, of the existing provisions on the exclusion or deferral of advance payments (advance payments, advance payments and advance payments), with the change in the fact that the increase in service is excluded for as long as the official has been largely qualified. The period of this unfavourable qualification is to increase the service incalculable.
Promotion.
(1) The promotion of an official will become a grant of a systemised post of a higher scale of the same service class.
(2) Special competence for the place to be lent, ability, fitness and credibility are decided for the promotion.
(3) A special government regulation may determine whether and when a successful performance of a special vocational examination is required for the promotion. Admission to the test shall not be denied if the conditions prescribed for them are met.
(4) In the case of promotion, the official on the new salary scale shall be a servant equal to the service available, unless such a servant on the new salary scale is closest to the service.
(5) The period to be counted at the current service level (with the current service allowance) is to be counted for the increase of the service if the new service is lower than the next service which the official would have achieved had he remained on the current salary scale. the period deductible at the highest level of the service (with the last service allowance) shall be counted up to the highest level of three years if the new service is the same as the previous service.
(6) In the case of officials in service positions of service class IC, provided for in paragraph 5, when the promotion takes place, the period to be counted at the existing level of service (with the current duty allowance) up to the maximum of three years, the period to be counted at the last duty allowance of the sixth scale up to the maximum of four years.
Transfer to upper class.
(1) If the official has fulfilled all the conditions for being admitted as a candidate to a post of senior service and has been accepted as such, he shall, for the duration of the period of waiting, retain the current salary in accordance with the procedure on the current salary scale if it is higher than the adjutum concerned; in the case of a provision by an official, they shall receive the appropriate scale in accordance with the rules applicable to the promotion (§ 15). In the absence of a service scale equal to or above the service scale, the service scale shall be the highest.
(2) Similarly, it is appropriate to proceed with the transfer of an official from the service class Ic to the service class Ib.
Transfer to lower pay scale.
If an official has been granted a service post systemised on a lower salary scale, he shall receive a service charge on that salary scale which would have been his if he had not been promoted.
Qualification.
Unless otherwise provided for in this Regulation, the current provisions on the qualifications of officials shall remain unchanged.
Service order.
(1) The current provisions on the rank of office shall apply with the change in the seniority of officials being determined by the length of the period of service spent in the characteristics of a definitively appointed official in the same grade at the same level of service at the same scale, by the seniority of the waiting period in the same official category in the national rail section. If an official in service class Ic is transferred to service class Ib, only the hours spent after the transfer shall be decided for the determination of the order.
(2) A period not attributable to the increase in the service (adjute) is not taken into account.
Official titles.
(1) The special government regulation shall determine the official titles of officials by post, taking into account the official category and the service class.
(2) These titles will take the place of current official titles.
(3) The official shall be entitled and be required to use the official title associated with the place of service given to him and shall be entitled to be appointed by that title. Pending a new modification of official titles, the official shall retain his current official title.
(4) Retired officials may, on all official occasions and in all submissions, continue to use the official title which was due to them when they were relocated, but must add to their official title a note indicating the retirement ratio.
Service uniform.
The provisions on uniform service and the obligation to carry it and on service badges shall be issued by a separate government regulation.
Recovered leave.
The existing provisions on the allowances for civil servants of the Member States shall be amended to determine:

Subofficial and set-up categories.
The following sub-official and establishment categories shall be established for national rail sections:

Subofficial and set-up candidates.
(1) A sub-official or set-up candidate may be established only if he has complied with the general conditions laid down for the provision of a sub-official or an administrator and the special conditions laid down for the provision of a sub-official or set-up category and the field of service and has two years of continuous service as a full-time force for a member of the national rail or other field of administration.
(2) The provisions of the Waiver shall be allowed only if, in the relevant category, there is an vacant, systemised post of sub-official or establishment. Each candidate is bound by one systemized service post.
(3) Only those who have actually spent a specified waiting period in the sub-official or set-up category in which they are to be established may be designated as a sub-official or controller with the exceptions provided for in paragraphs 5 and 6.
(4) A waiting period of four years shall be fixed for candidates for sub-official and establishment posts on the Ia, Ib and II. scale, in the III.
(5) In the category of workshops, bridge locksmiths, helpers, shippers, operating guards, train guides, storekeepers, line officers, telegraph officers, heating workers, track craftsmen, track drivers, diggers, wagon recorders, supply workers and railway officers, service posts are provided systemically in higher scales by promotion (§ 50) from the lowest relevant scale. The subordinate's posts shall be awarded by promotion (Paragraph 50) to the helpers of the workshop. The service posts of the station concierge and official assistants shall be filled exclusively by staff of other categories established at service posts systemised at least in the 2nd scale which have become unfit for service in their category.
(6) For particularly serious service reasons, the Government may, on a case-by-case basis, authorise the consent of the Ministry of Transport and the Ministry of Finance to allow waiting periods to be shortened or waived. This right shall be exercised by the Directorate of State Railways, if the founder or sub-officer who has already complied with the condition laid down in paragraph 3 is to be taken over in another category of establishment or sub-official. The Directorate of State Railways may also authorise the candidate to shorten the waiting period by the time spent in the waiting relationship in another constituent or sub-official category.
(7) The provisions of this Regulation on sub-officials and founders apply, unless otherwise specified, to sub-officials and set-up candidates.
(8) The waiting salary is determined by a special government regulation.
(9) Paragraph 7 applies mutatis mutandis.
Staff salary of sub-officials and set-up.
The service salary of the sub-official and set-up shall consist of a service, an activity and an education fee.
