GOVERNMENT REGULATION
of 5 April 2006
amending Government Regulation No 396 / 2001 Coll., on the use of the resources of the State Housing Development Fund for the repair and modernisation of flats, as amended
The Government orders pursuant to Section 9 of Act No. 211 / 2000 Coll., on the State Housing Development Fund and on the amendment of Act No. 171 / 1991 Coll., on the jurisdiction of the authorities of the Czech Republic in the case of transfers of State property to other persons and on the National Property Fund of the Czech Republic, as amended:
Government Decree No. 396 / 2001 Coll., on the use of the resources of the State Housing Development Fund for the repair and modernisation of flats, as amended by Government Decree No. 397 / 2002 Coll. and Government Decree No. 59 / 2004 Coll., is amended as follows:
1. in Article 4a (1), points (a) and (e) are deleted;
Points (b) to (d) shall be renumbered as points (a) to (c).
2. In Paragraph 4a (1), the words "in 2002 'are deleted.
3. in Paragraph 4a (1) (a), the words "emergency" are replaced by the words "emergency or emergency."
4. in Paragraph 4a (2), "(d) 'is replaced by" (c)';
5. in Article 4b (1) and (2), the words "in 2002" shall be deleted;
6. In Article 4b (4), in the introductory part of the text comma after the word "house ', the words" where the owner is involved, showing that within the last 10 years before the date of the declaration of the state of danger or emergency, he has received support from the State budget or budget of the Fund for the repair of a building, or an apartment owned, or common parts of a house damaged by one of the previous floods, a contribution of up to 90% of the total cost of the repair of a building, an apartment owned or common parts of the house may be granted. However, the contribution may always be' and the word 'however' shall be deleted.
7. In Paragraph 4b (8), the words "30 June 2004 'are replaced by the words" 2 years after the date of notification of the state of danger or emergency'.
Transitional provision
Legal relations arising under Government Regulation No 396 / 2001 Coll., as effective until the date of entry into force of this Regulation, and the rights and obligations arising therefrom shall be governed by existing legislation.
Efficacy
This Regulation shall enter into force on the day of its publication.
