DECLARATION
of 27 March 2003
on the recording of surface water and groundwater status and how data are stored in the public administration information system
The Ministry of Agriculture, in cooperation with the Ministry of the Environment, provides pursuant to § 21 paragraph 2 of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act):
§ 1
Subject matter
This decree sets out the scope of the data included in the record keeping
(a) watercourses and their basins, hydrogeological zones and artificial aquatic bodies;
(b) the quantity and quality of surface and groundwater;
(c) sampling of surface water and groundwater, discharges of waste and mining water and accumulation of surface water in water tanks;
(d) the catchment area;
(e) protected areas of natural water accumulation;
(f) water source protection zones,
(g) surface water sources which are used or are expected to be used as drinking water sources;
(h) sensitive areas;
(i) vulnerable areas;
(j) bathing surface water areas;
(k) water works for the water-management melodies of land;
(l) flood areas and the way in which these data are stored in public administration information systems pursuant to § 22 (3) and (4) of the Water Act.
§ 2
Water-courses and their basins, hydrogeological zones and artificial water bodies
(1) Water flows and their basins are to be recorded within the scope of the data provided for in the specific legislation1) on their names, their number and water flow identifier, their water flow length, their water flow manager and their number of hydrological river basin identifiers.
(2) The water flows and their catchment areas are, to the extent of the data referred to in paragraph 1, based on the geographical data of the Czech Republic. The source of water flow numbering and their water catchment areas is the hydrological model of the water flow network created on the basis of the basic base of geographical data of the Czech Republic.
(3) Hydrogeological zones shall be recorded in the scope of their names, number identifiers, river basin managers and hydrogeological ramifications boundaries provided for in specific legislation.2)
(4) Artificial water bodies which, for the purposes of this decree, mean water tanks are to be recorded within the scope of the data provided for by the specific legislature (m3), with the exception of water work management data.
(5) The data for the information system of the public administration for the register of watercourses and their water catchment areas are stored by the Research Institute of Water Management T. G. Masaryk, for the registration of artificial water bodies the data is stored by the river managers and for the registration of hydrogeological sites the data is stored by the Czech Hydrometeorological Institute.
§ 3
Registration of quantities and quality of surface and groundwater
(1) The quantity of surface water is recorded in the range of data on the total water outflow and data on the natural water flow in the water flow in selected water stations according to the hydrological balance output of the water.4)
(2) The quality of surface water shall be recorded in the range of data of characteristic values of surface water quality indicators, laid down by specific legislation, (5) calculated from measured values in the state network of surface water quality monitoring profiles operated by the Czech hydrometeorological institute (6) and to the extent of data of characteristic values of surface water quality indicators calculated from values measured by river managers in embedded water flow profiles. 7)
(3) The quantity of groundwater shall be recorded within the range of the basic effluent data for each hydrogeological area within the river basin areas, according to the hydrological balance of water output. 7)
(4) The quality of groundwater is recorded in the range of the characteristics of the groundwater quality indicators laid down by the specific legislation, 8) calculated from measured values in the bodies of the national groundwater monitoring network and in the spring monitoring network operated by the Czech hydrometeorological institution.6)
(5) The data referred to in paragraphs 1 to 4 for the registration of the quantity and quality of surface and groundwater from the national network of surface and groundwater quality monitoring profiles and selected horizontal stations are stored in the public administration information system by the Czech hydrometeorological institute. The data referred to in paragraph 2 shall be stored by the competent river basin administrator in the public administration information system for the quality of surface water from the embedded profiles.
§ 4
Registration of surface and groundwater sampling, discharge of waste and mining water and accumulation of surface water in water tanks
(1) Surface and groundwater sampling, waste and mining water discharges and accumulation of surface water in water tanks subject to the reporting obligation for water balance, (9) shall be recorded in the range of data for surface and groundwater sampling, waste and mining water discharges and the accumulation of surface water in water tanks, as laid down in a specific legislation. 10)
(2) Data into the public administration information system for the recording of surface and groundwater sampling, discharges of waste and mining waters and accumulation of surface water in water tanks are stored by the river basin manager.
§ 5
Recording of river basin areas
(1) The river basin areas shall be recorded within the scope of the information provided for in the specific legislation.2)
(2) Data for the records of river basin areas are stored in the public administration information system of the river basin administrator.
§ 6
Registration of protected areas of natural water accumulation
(1) The protected areas of natural water accumulation are recorded within the scope of the data provided for in the specific legislation. 11)
(2) Data for the registration of protected areas of natural water accumulation are stored in the public administration information system by the Research Institute of Water Management T. G. Masaryk.
§ 7
Registration of water source protection zones
The protection zones of aquatic resources shall be recorded within the limits of the data provided for in the specific legislation. 12)
§ 8
Records of surface water sources used or expected to be used as drinking water sources
(1) The sources of surface water which are used or which are expected to be used as drinking water shall be recorded within the scope of the data provided for in the specific legislation. 13)
(2) The Ministry of Agriculture places in the public administration's information system data for the recording of surface water resources used or intended to be used as a source of drinking water.
§ 9
Records of sensitive areas
(1) Sensitive areas shall be recorded within the scope of the data provided for in the specific legislation. 14)
(2) The data for the records of sensitive areas are stored in the information system of the public administration by the Research Institute of Water Management T. G. Masaryk.
§ 10
Records of vulnerable areas
(1) Vulnerable areas shall be recorded within the scope of the data provided for in the specific legislation. 15)
(2) Data for the records of vulnerable areas are stored in the public administration information system by the Research Institute of Water Management T. G. Masaryk.
§ 11
Registration of bathing surface water areas
(1) The areas of surface water used for bathing are recorded within the scope of the data provided for by the specific legislation (Section 34 (1) of the Water Act).
(2) Data for the recording of surface water areas used for bathing is stored in the public administration information system by the Research Institute of Water Management, T. G. Masaryk.
§ 12
Registration of water works for land waterworks
(1) Water works for the water treatment of land shall be recorded within the scope of the data provided for in the specific legislation. 12)
(2) The data for the registration of water works for land waterproofing is stored in the public administration information system by the Agricultural Water Administration.
§ 13
Registration of flood areas
(1) The designated flood areas shall be registered within the following limits:
(a) name of the watercourse;
(b) water flow manager;
(c) hydrological order number,
(d) the kilometer of the beginning and end of the water flow section of the specified flood area;
(e) the codes and names of the municipalities on whose territory the flood territories are established;
(f) the code of the water authority which established the flood area;
(g) the date and the reference number of the designation by the Water Authority of the flood area.
(2) The data for the records of flood areas are stored in the information system of the Public Administration Research Institute of Water Management T. G. Masaryk.
§ 14
How to store data in the public administration information system
(1) Data are stored in the public administration information system managed by the Ministry of Agriculture and the Ministry of the Environment in such a structure as to enable all parts of the data to be shared through a defined reference, shared and secure interface, 16) including by remote access.
(2) The data provided for in Sections 2 and 5 to 13 are kept in the public administration information system on an ongoing basis, the data provided for in Sections 3 and 4 are stored for the previous calendar year no later than 30 June of the current year.
§ 15
Transitional and final provisions
If the water flow and its water catchment area are not conducted within the scope of the data referred to in Article 2 (1) on the basis of the geographical data of the Czech Republic, the basic hydrological model of the water flow network, established on the basis of the basic water management map of the Czech Republic on the scale of 1: 50 000, may be used to detect these data until 31 December 2006.
§ 16
Efficacy
This Decree shall take effect on 1 July 2003.
