on the adjustment of compensation for loss of earnings after invalidity or invalidity
The Government of the Czech and Slovak Federal Republic hereby orders pursuant to Paragraph 447 (3) of the Civil Code:
(1) Compensation for loss of earnings after invalidity or invalidity under civil law is adjusted by increasing the average profit for the calculation of such compensation by the following percentages:
(a) 2% for each calendar year following entitlement to this refund until 31 December 1989;
(b) 5% for the calendar year 1990,
(c) 5% for the first half of 1991.
(2) The compensation referred to in paragraph 1 (a) shall not be payable to the injured person for the period during which he was entitled to the adjustment of compensation for loss of earnings under the Decree of the Government of the Czechoslovak Socialist Republic No 17 / 1983 Coll., on the adjustment of certain compensation for loss of earnings after the end of his disability or disability.
(3) The adjustment provided for in paragraph 1 shall be made at the request of the injured party, even where, after 31 December 1980, the compensation for the loss of earnings after the cessation of incapacity for work or invalidity was not due to this because the legislation on the amounts limiting the method of calculation and the granting of such compensation did not allow it.
(1) The compensation for the loss of earnings after the cessation of incapacity for work or invalidity shall also be paid after the adjustment made under § 1 of § 447 (2) of the Civil Code.
(2) An increase in invalidity or partial invalidity pension under social security legislation shall not be taken into account when adjusting the compensation for loss of earnings under Paragraph 1.
Compensation for loss of earnings adjusted under this Regulation shall be payable by the Government from 1 December 1991.
This Regulation shall enter into force on the day of its publication.
